Some of our conduct hearings have demonstrated that the mishandling of family court papers is increasingly becoming an issue that we need to be more mindful about.
To ensure that the rights of vulnerable children and adults are properly safeguarded, it is essential that great care is taken when handling family court papers. These confidential documents may be knowingly disclosed, for example by submitting them as part of a job application. Information can also be unwittingly revealed if documents are left lying around or are not disposed of correctly. This could have serious consequences, including possible physical risks to children or adults, if sensitive details are leaked.
There are strict rules about the confidentiality of family court papers. In particular, the Family Proceedings Rules prohibit the disclosure, in any Children Act proceedings, of any documents relating to the proceedings, other than to specified groups of people, without the permission of the judge. Breaking these rules and disclosing confidential details can amount to contempt of court which is punishable by imprisonment or a fine. It may also be considered a professional conduct issue and could lead to GSCC conduct proceedings.
